The agreement for submitting information, contacting performers, subscribing, reviewing shows, and managing a performer page on FindMagic.

These Terms are an agreement between you and FindMagic Ltd, the operator of FindMagic from British Columbia, Canada. They apply when you create or use a performer account or submit an enquiry, review, subscription, follow request, correction, listing, or other contribution. Browsing public pages, making a privacy or removal request, reporting a concern, and unsubscribing do not require agreement to these Terms. The Privacy Policy explains how personal information is handled; acknowledging it does not waive any privacy right.
Fan submissions are for people aged 13 or older. A performer account may be controlled only by an adult performer or an adult parent, guardian, manager, agent, or other representative authorised to act for the performer. If you act for an organisation or another person, you confirm you have authority to bind or represent them for the action you take.
What FindMagic does
FindMagic helps people discover public magic shows and performers available for hire. It provides free directory pages, profile-management tools, direct enquiry routes, email discovery features, and public information that search engines and assistants can understand. FindMagic may collect, compare, edit, and publish relevant information from public sources and submitted corrections to keep the directory useful and accurate.
FindMagic is not a performer, venue, booking agent, ticket seller, employer, party to a performance contract, or guarantor of any user. It does not take booking payments or a commission. A listing, badge, review, ranking, verification method, or claimed profile is not an endorsement, licence check, background check, guarantee of availability, or promise that an event will occur.
Bookings, shows, and third parties
An enquiry is forwarded to the performer or booking destination you select. You and the performer are responsible for availability, suitability, safeguarding, accessibility, fees, taxes, contracts, deposits, insurance, permits, cancellations, and the performance itself. Ticket purchases and refund rights are governed by the venue or seller linked from a show page. Confirm important details directly before travelling, paying, or making commitments.
FindMagic links to performer, venue, ticketing, video, map, and other third-party services. FindMagic does not control their availability, content, contracts, security, or privacy practices and is not responsible for a third party merely because a link appears in the directory.
Accounts and performer pages
You must provide accurate information, keep sign-in links and devices reasonably secure, and notify FindMagic if an account or claim is compromised. Do not claim a performer page unless you are the performer or are authorised to manage it. FindMagic may request further verification, resolve competing claims, restrict sensitive changes, revoke sessions, or return a page to an unclaimed state when necessary to protect the performer or directory.
A claimed performer controls editable profile information and booking settings, subject to these Terms and factual records such as sourced public show dates. FindMagic may preserve source, correction, consent, moderation, security, and removal records even after a public page changes or is removed. Claiming a page does not transfer ownership of FindMagic’s software, page design, compilation, URLs, analytics, or other platform materials.
Your submissions and permission to use them
You keep ownership of original text, images, and other material you submit. You give FindMagic a worldwide, non-exclusive, royalty-free licence to host, copy, resize, format, edit for clarity, publish, distribute, and make that material available through the directory and its machine-readable public surfaces for as long as needed to provide the feature or maintain a defensible historical record. This permission ends for future public use when material is removed, except for cached copies, backups, legal records, and material another person independently supplied or has a right to use.
You confirm that your submission is accurate to the best of your knowledge, is not confidential, and that you have the rights and permissions needed to submit it. Reviews must describe a genuine experience or clearly disclosed relationship and must not be bought, coerced, fabricated, or manipulated. FindMagic may label the verification route, edit formatting, decline publication, request evidence, remove content, or preserve a copy for moderation and dispute purposes.
Acceptable use
Do not use FindMagic to impersonate someone, deceive, harass, threaten, discriminate unlawfully, invade privacy, infringe intellectual-property or publicity rights, publish secrets, send spam, scrape in a way that disrupts the service, bypass access controls, probe for vulnerabilities without written permission, upload malware, manipulate rankings or reviews, submit unlawful content, or use contact routes for unrelated solicitation.
Automated services may read public pages and the published agent and sitemap surfaces at a reasonable rate. They may not use private routes, evade technical limits, reconstruct private data, or represent that FindMagic endorses their output. FindMagic may rate-limit, reject, moderate, suspend, or block activity that threatens people, performers, data quality, or service operation.
Email choices
Agreeing to these Terms is not agreement to receive marketing email. City subscriptions and performer follows use a separate choice and confirmation step. Service messages needed to verify an address, deliver a requested enquiry, secure an account, or respond to you are not promotional subscriptions. Every promotional message provides the relevant preference or unsubscribe route.
Do not subscribe an address you do not control. FindMagic may pause or end a subscription after delivery failures, abuse reports, or an unsubscribe request. A performer may use a confirmed follower address shared through the clearly labelled follow feature only consistently with the permission shown there and applicable anti-spam law.
Service changes and enforcement
FindMagic may correct facts, change features, moderate or remove content, suspend access, or discontinue the service. Where practical, it will give affected account holders reasonable notice of a material change. It may act without advance notice to address security, abuse, legal demands, impersonation, misleading content, or immediate harm. A performer can request removal and a fan can unsubscribe or make a privacy request without accepting updated Terms.
If you breach these Terms, FindMagic may restrict the relevant submission or account. Provisions that by their nature should continue—including ownership, licences for retained records, disclaimers, liability limits, dispute terms, and accrued obligations—survive termination.
Disclaimers and limits
FindMagic is provided on an “as available” basis. To the fullest extent law permits, FindMagic disclaims implied warranties of accuracy, fitness, merchantability, non-infringement, availability, and results. Public facts and event schedules can be incomplete, changed, or wrong. Nothing in these Terms excludes a warranty, remedy, or responsibility that applicable consumer law does not allow to be excluded.
To the fullest extent law permits, FindMagic is not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages, or for a performer, venue, seller, event, contract, payment, third-party site, or user submission. For other claims, FindMagic’s total liability arising from the service will not exceed the greater of CAD $100 and the amount you paid FindMagic in the twelve months before the claim. This limit does not apply where law prohibits it, or to fraud, wilful misconduct, or liability that cannot lawfully be limited.
Governing law and resolving concerns
Contact hello@findmagic.show first so a person can try to resolve a concern. These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any mandatory consumer right to bring a claim elsewhere, the courts of British Columbia have jurisdiction. These Terms do not require arbitration and do not waive participation in a class proceeding where one is otherwise available.
If one provision is unenforceable, it will be limited or removed only as necessary and the rest will continue. A delay enforcing a provision is not a waiver. You may not transfer these Terms without consent; FindMagic may transfer them with the service while preserving applicable rights. These Terms and the policies they expressly incorporate are the entire agreement about use of the service.
Changes and contact
The effective date and revision identify these Terms. FindMagic may update them as the service or law changes. Material updates will be posted prominently and existing performer account holders may be asked to accept the new revision before continuing to use account features. Changes do not retroactively rewrite a dispute that arose before they took effect.
